These Terms of Service ("Terms") govern your access to and use of the AskBuyers website, applications, and services (collectively, the "Services"). By using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Accounts and Eligibility

  • You must be at least 18 years old and capable of forming a binding contract.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.

Acceptable Use

  • Use the Services only for lawful purposes and in accordance with these Terms.
  • Do not misuse the Services, interfere with their normal operation, or attempt unauthorized access.
  • Do not post unlawful, misleading, or infringing content.

Listings, Proposals, and Payments

  • We are a platform facilitating connections between sellers and real estate agents.
  • We do not broker real estate transactions and are not a party to agreements between users.
  • Users are solely responsible for verifying information and complying with applicable laws.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKBUYERS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRIOR TO THE EVENT.

Indemnification

You agree to indemnify and hold AskBuyers harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

Termination

We may suspend or terminate your access to the Services at any time for any reason, including if we reasonably believe you have violated these Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue in those courts.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Effective date” above. Your continued use of the Services constitutes acceptance of the changes.
